Commercial Litigation

In a case involving jurisdictional issues, the Firm’s client was a Delaware corporation which had contracted with the plaintiff, a New Jersey Corporation doing business in El Segundo, California. The plaintiff sued the client in El Segundo for allegedly breaching the contract. The Firm sought to have the matter dismissed on the grounds that the case had to be tried in Delaware because the client had insufficient contacts with the state of California. When the trial court denied the motion, the Firm sought and obtained a writ of mandamus on appeal. The appellate court agreed with the Firm’s position and directed the trial court to dismiss the action.
